Terms of Service
Last Updated: June 2024
Welcome to BrokerLogic. By accessing or using our website, services, and software platform (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
1. Description of Service
BrokerLogic provides an automated document collection, classification, and routing platform designed for licensed Mortgage Brokers. The Service utilizes Artificial Intelligence to triage documents and API integrations to route documents to third-party storage providers (e.g., Microsoft OneDrive).
2. Broker Responsibilities
If you are a Mortgage Broker using the Service, you represent and warrant that:
- You have obtained all necessary, legally required consent from your clients to collect, process, and upload their personal and financial documents to our Service.
- You are solely responsible for the security of your own Microsoft OneDrive account and BrokerLogic login credentials.
- You will not use the Service for any unlawful purpose or to process documents unrelated to legitimate mortgage origination activities.
3. AI Accuracy and Disclaimer
While BrokerLogic utilizes advanced Artificial Intelligence to classify and rename documents, the technology is not infallible. The Broker is solely responsible for verifying the accuracy of all document classifications, extracted metadata, and file names prior to submitting them to a lender. BrokerLogic accepts no liability for delayed, rejected, or denied mortgage applications resulting from misclassified documents.
4. Limitation of Liability
To the maximum extent permitted by applicable law, BrokerLogic Inc. and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any unauthorized access, use, or alteration of your transmissions or content.
5. Service Interruptions
We strive to ensure maximum uptime; however, the Service relies on third-party infrastructure (such as Amazon Web Services and Google Cloud). We do not guarantee uninterrupted access to the Service and will not be held liable for any temporary downtime.
6. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
